What is a Violation?

A violation is any action taken by a licensed social worker that is contrary to North Dakota Law (North Dakota Century Code), or North Dakota Administrative Rules, including the code of ethics adopted by the NDBSWE.

Authority

NDBSWE is authorized by law to take disciplinary action against a license if the licensee has violated North Dakota law and/or administrative rule.  The law establishing the NDBSWE was enacted by the legislature as a means of protecting the safety and welfare of the public.  N.D.C.C. 43-41-10 lists the grounds for which the NDBSWE may deny, refuse to renew a license, suspend, revoke, reprimand, restrict, limit a license, or place a license on probationary status.

The NDBSWE and its legal counsel may not offer legal advice to the public or licensees.  If you feel you need advice on whether or not to report a potential violation, you should seek private legal counsel

Unlicensed Practice of Social Work

Persons calling themselves a social worker or practicing social work without a valid North Dakota social work license are in voilation of North Dakota law. The NDBSWE has no jurisdiction over unlicensed individuals. Such individuals should be reported to the county state's attorney.
